Amit Shah to introduce bills for removal of PM, CMs, Ministers held on serious criminal charges in Lok Sabha
1. The Constitution (One Hundred and Thirtieth Amendment) Bill, 2025
What it proposes:
This bill aims to amend the Constitution—specifically Articles 75, 164, and 239AA—to create a legal mechanism for the removal of high-ranking ministers (including the Prime Minister, Union Ministers, Chief Ministers, and Ministers in Union Territories) if they are arrested and detained for a serious criminal offense. The requirement is that the detention lasts at least 30 days, and unless they tender an explanation by the 31st day, they cease to hold office.
It was introduced in the Lok Sabha by Union Home Minister Amit Shah and referred to a Joint Parliamentary Committee for further consideration.
2. The Government of Union Territories (Amendment) Bill, 2025
Purpose:
The existing Government of Union Territories Act, 1963 lacks provisions for removing Chief Ministers or ministers in Union Territories if they are arrested on serious criminal charges. This bill proposes to amend Section 45 of the Act to fill that gap by providing a legal framework for their removal under such circumstances.
It is part of the same legislative package introduced by Amit Shah and sent to the Joint Committee.
3. The Jammu and Kashmir Reorganisation (Amendment) Bill, 2025
Objective:
Under the Jammu and Kashmir Reorganisation Act, 2019, there’s currently no provision for removing the Chief Minister or ministers if they face serious criminal allegations and are arrested. This bill proposes an amendment to Section 54 to include such removal provisions.
Like the earlier two, it was introduced alongside them and referred to the Joint Parliamentary Committee.
4. The Promotion and Regulation of Online Gaming Bill, 2025
Key provisions & status:
This bill would establish a National Online Gaming Commission (or similar authority) to license and regulate online gaming platforms. The core aim is to ban money-based online games—those involving real-money deposits or wagering. At the same time, the bill distinguishes and allows e-sports, fantasy sports, and other skill-based games, while banning games of chance. It also includes consumer safeguards such as age/identity verification, responsible gaming measures, advertisement controls, segregation of player funds, grievance redressal, and penalties for non-compliance.
The Union Cabinet approved the bill in mid-August, and it is being introduced in the Lok Sabha by IT Minister Ashwini Vaishnaw.
